Welcome to TradingPal. These Terms of Service ("Terms") govern your access to and use of the TradingPal mobile application and services. By using TradingPal, you agree to these Terms.

1. Acceptance of Terms

By accessing or using TradingPal, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Service

TradingPal provides:

• AI-powered trading psychology coaching
• Trade journaling and analytics tools
• Performance tracking and insights
• Educational content and routines
• Market data integration

We reserve the right to modify, suspend, or discontinue any part of our service at any time.

3. User Accounts

Account Creation

• You must be at least 18 years old to use TradingPal
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You may not share your account credentials

Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or misuse the service
• Fail to pay applicable fees

4. Subscription and Payments

Subscription Plans

TradingPal offers various subscription tiers with different features. Pricing is subject to change with notice.

Billing

• Subscriptions are billed through the Apple App Store
• Automatic renewal unless cancelled 24 hours before period ends
• Refunds are handled per Apple's policies
• No refunds for partial subscription periods

Free Trial

If offered, free trials convert to paid subscriptions unless cancelled before the trial period ends.

5. Acceptable Use

You agree NOT to:

• Use TradingPal for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer or decompile the application
• Scrape, mine, or harvest data from our services
• Upload malicious code or viruses
• Impersonate others or provide false information
• Interfere with other users' access
• Use automated systems to access the service

6. Content and Intellectual Property

Your Content

You retain ownership of your trade journals, notes, and data. By using TradingPal, you grant us a limited license to:

• Process your data to provide services
• Use anonymized data to improve our AI models
• Display your content back to you in the app

Our Content

All TradingPal materials, including design, text, graphics, and software, are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our content without permission.

7. AI Coach and Educational Content

Always conduct your own research and consult licensed financial professionals before making trading decisions.

8. Disclaimers and Limitations

Service Availability

TradingPal is provided "AS IS" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or completeness of data
• Results or outcomes from using the service
• Compatibility with all devices

Trading Risks

You acknowledge that:

• Trading involves risk of financial loss
• Past performance does not predict future results
• Market data may be delayed or inaccurate
• You are solely responsible for your trading decisions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• TradingPal is not liable for any trading losses
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not liable for third-party services or data providers

10. Indemnification

You agree to indemnify and hold harmless TradingPal, its officers, directors, and employees from any claims, losses, or damages arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Your trading activities

11. Third-Party Services

TradingPal integrates with third-party services (e.g., market data providers, AI APIs). These services have their own terms and we are not responsible for their availability or accuracy.

12. Privacy and Data

Your use of TradingPal is subject to our Privacy Policy. We collect and process data as described in that policy.

13. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Arbitration

Any disputes will be resolved through binding arbitration rather than in court, except you may assert claims in small claims court.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
